Ohio Attorney Dean Boland Photoshopped Kids Pictures Into Porn Lawsuit

Dean Boland, an Ohio attorney, is facing a child porn lawsuit after he photoshopped kids pictures. Among Boland's list of offenses is "transforming a picture of a 5 year old girl eating a doughnut into one of her having oral sex."

Boland allegedly purchased photos of four very young girls from a Canadian website offering stock images and digitally enhanced the photos into child pornography for exhibits within a defense case in 6 child porn cases. Boland attempted to prove the present laws are "unconstitutionally overbroad" and is now subject of a $300,000 lawsuit filed by the childrens' parents. Boland's exhibits allowed one of his clients to be cleared of potential child pornography prosecution.

Boland has insisted his immunity from the lawsuits, as he was hired as an expert witness for the case, and claimed that the images were intended for court. The 6th US Circuit Court of Appeals refuted his claims. A three judge panel ruled Wednesday "[N]o constitutional principle...allows a criminal defendant to defend one criminal charge by urging his lawyer or witness to commit another. Otherwise, an individual on trial for a murder-by-stabbing charge could try to prove that the knife was not long enough to kill someone by using it to stab someone else in the middle of a trial."

The court also maintained that "Boland could have illustrated the difficulty of discerning real from virtual images by combining two innocent pictures into another innocent picture...He crossed the line between possessing lawful images and violating the statute."
